The attack represents a brazen escalation of the Israeli occupation and apartheid regime’s systematic targetting of Palestinian students and educational institutions.</span></span></span></span></span></span></p> <p><span style="font-size:12pt; font-variant:normal; white-space:pre-wrap"><span style="font-family:'Times New Roman'"><span style="color:#000000"><span style="font-weight:400"><span style="font-style:normal"><span style="text-decoration:none">Upon the attack, Israeli Occupation Forces (IOF)—including undercover special forces—infiltrated the campus in a white van, targeting a student council organizational meeting held by over a dozen students, among them the heads of various student blocs. Undercover forces proceeded to shoot in the air and at the gathered students, shooting and wounding student Ismail Barghouthi in the thigh. Accompanying soldiers, alongside the undercover special forces, began arbitrarily arresting students, detaining the wounded student Ismail Barghouthi, Abdel Hafez Sharabati, Waleed Harazneh, and Qassem Nakhkeh. Ismail Barghouthi, who continues to be detained, was transferred to a hospital in Jerusalem for treatment for the gunshot wound. Later in the evening, two of the detained students, Abdel Hafez Sharabati and Waleed Harazneh, were released. Israeli occupation authorities continue to detain Ismail Barghouthi, Mohammad Khatib, who was transferred to interrogation at the Ben Yom Police Station in Jerusalem, and Qassam Nakhleh in Ofer prison, who sustained a broken leg injury during his arrest. The three detained Palestinian students are set for a court hearing before Ofer Military Court on Thursday, 13 January 2022, for an extension of their detention.</span></span></span></span></span></span></p> <p><span style="font-size:12pt; font-variant:normal; white-space:pre-wrap"><span style="font-family:'Times New Roman'"><span style="color:#000000"><span style="font-weight:400"><span style="font-style:normal"><span style="text-decoration:none">The violent storming, shooting, and arrest of Palestinian university students comes amid the Israeli occupation’s escalatory attacks against Palestinian civil society, cultural and educational institutions, and Birzeit University in particular. Only one month prior, on 14 December 2021, IOF stormed Birzeit University at dawn, launching tear gas bombs, vandalizing the campus, and attacking university guards.</span></span></span></span></span></span></p> <p><span style="font-size:12pt; font-variant:normal; white-space:pre-wrap"><span style="font-family:'Times New Roman'"><span style="color:#000000"><span style="font-weight:400"><span style="font-style:normal"><span style="text-decoration:none">More still, on 11 January 2022, IOF attacked a march by Palestinian students and supporters condemning the Israeli occupation’s attack of Palestinian students the day prior, assaulting protestors, launching tear gas bombs, and shooting rubber-coated steel bullets. The Palestinian Red Crescent reported 12 injuries thus far, including five wounded by rubber-coated steel bullets and seven wounded by tear gas.</span></span></span></span></span></span></p> <p><span style="font-size:12pt; font-variant:normal; white-space:pre-wrap"><span style="font-family:'Times New Roman'"><span style="color:#000000"><span style="font-weight:400"><span style="font-style:normal"><span style="text-decoration:none">Palestinian youth and students are systematically targeted as part of the Israeli occupation’s protracted silencing campaign. Students at Birzeit University especially have been subject to systematic attacks, IOF raids, arbitrary detention, and torture and ill-treatment, all of which aim to maintain the Israeli occupation and apartheid regime over the Palestinian people. Beyond physical assault, many of Birzeit’s students have been further subject to torture and ill-treatment during their detention and interrogation.</span></span></span></span></span></span></p> <p><span style="font-size:12pt; font-variant:normal; white-space:pre-wrap"><span style="font-family:'Times New Roman'"><span style="color:#000000"><span style="font-weight:400"><span style="font-style:normal"><span style="text-decoration:none">The violent harassment and targeting of Palestinian universities and students directly impede Palestinian’s right to education, which is explicitly protected in Article 26 of the Universal Declaration of Human Rights and Article 13 of the International Covenant on Economic, Social, and Cultural Rights (ICESR). In 2021, the Israeli occupation arbitrarily arrested and detained more than a hundred Palestinian Students.</span></span></span></span></span></span></p> <p><span style="font-size:12pt; font-variant:normal; font-variant:normal; white-space:pre-wrap"><span style="font-family:'Times New Roman'"><span style="color:#262526"><span style="font-weight:400"><span style="font-style:normal"><span style="text-decoration:none">Israeli Occupation Forces (IOF) arrested Mohammad Al-Natsheh, 17 years old at the time,  at 11 pm on 21 May 2021 on the street in Ras Al-Amud, Jerusalem. Upon his arrest, an IOF soldier jumped Mohammad from behind, pulling him to the other side of the street, then tied his hands to the back with plastic straps, blindfolding him with a mask, and took him to a military jeep where a soldier sat next to him and ordered him not to move at all. Mohammad was taken to a police station in Salah Al-Deen, then transferred to Al-Mascobiya Interrogation Center. As he was walking upstairs, an Israeli police officer hit him in the face, causing him to fall on the stairs and injure his shoulder and knee, yet he was left without the necessary medical treatment. The police officer forced Mohammad to sit on the ground without moving, threatening to be beaten if he moved. Mohammad sat on his knees, during which he was hit in the face and deliberately trampled on his toes, even as he had lost his shoes during his previous fall from the stairs. Mohammad remained in this position for over two hours before being transferred to a cell.</span></span></span></span></span></span></p> <p><span style="font-size:12pt; font-variant:normal; white-space:pre-wrap"><span style="font-family:'Times New Roman'"><span style="color:#262526"><span style="font-weight:700"><span style="font-style:normal"><span style="text-decoration:none">Interrogation in Al-Mascobiyah</span></span></span></span></span></span></p> <p><span style="font-size:12pt; font-variant:normal; white-space:pre-wrap"><span style="font-family:'Times New Roman'"><span style="color:#262526"><span style="font-weight:400"><span style="font-style:normal"><span style="text-decoration:none">Palestinian child detainee Mohammad was held in a freezing and filthy cell containing a small and thin mattress and strong lights that did not turn off. He was held in the cell for about 18 days, between rounds of interrogation.</span></span></span></span></span></span></p> <p><span style="font-size:12pt; font-variant:normal; white-space:pre-wrap"><span style="font-family:'Times New Roman'"><span style="color:#262526"><span style="font-weight:400"><span style="font-style:normal"><span style="text-decoration:none">Before being transferred to his first round of interrogation, Mohammad was taken to a dark room and was made to sit, untied, on a chair. Every time he moved to straighten his seat, an interrogator would scream at him. He was also hit on the face several times during the nearly hour and a half he spent in this room. He was transferred to the interrogation room, interrogated for hours, including eight continuous hours on his first day. The interrogators tried to pressure the child Mohammad in various ways to change his answers. The first time he was allowed to shower was a week following his detention, and he was not allowed to change his clothes even though his family went to Al-Mascobiyah to send clothes for him. Mohammad was also served poor food, where meals were not enough and extremely poor quality. </span></span></span></span></span></span></p> <p><span style="font-size:12pt; font-variant:normal; white-space:pre-wrap"><span style="font-family:'Times New Roman'"><span style="color:#262526"><span style="font-weight:700"><span style="font-style:normal"><span style="text-decoration:none">Legal Status</span></span></span></span></span></span></p> <p><span style="font-size:12pt; font-variant:normal; white-space:pre-wrap"><span style="font-family:'Times New Roman'"><span style="color:#262526"><span style="font-weight:400"><span style="font-style:normal"><span style="text-decoration:none">Following Mohammad’s harsh interrogation, the Israeli Public Prosecution submitted an indictment against him, including articles alleging the throwing of Molotov cocktails. On 9 November 2021, the Israeli District Court in occupied Jerusalem sentenced Mohammad to 14 months in prison and four months of prison suspended for two years.</span></span></span></span></span></span></p> <p><span style="font-size:12pt; font-variant:normal; white-space:pre-wrap"><span style="font-family:'Times New Roman'"><span style="color:#262526"><span style="font-weight:400"><span style="font-style:normal"><span style="text-decoration:none">Notably, Mohammad was arrested as a minor and imprisoned in Damon Prison in the juvenile section. After his verdict, he reached 18 years and was transferred to Ramon Prison to serve the remainder of his sentence.</span></span></span></span></span></span></p> <p><span style="font-size:12pt; font-variant:normal; white-space:pre-wrap"><span style="font-family:'Times New Roman'"><span style="color:#262526"><span style="font-weight:700"><span style="font-style:normal"><span style="text-decoration:none">The Israeli Occupation’s Detention of Children and Physical and Psychological Torture</span></span></span></span></span></span></p> <p><span style="font-size:12pt; font-variant:normal; white-space:pre-wrap"><span style="font-family:'Times New Roman'"><span style="color:#262526"><span style="font-weight:400"><span style="font-style:normal"><span style="text-decoration:none">IOF continue to arrest Palestinian children and subject them to various types of torture and ill-treatment, with no consideration to the child’s mental and physical condition, despite the signing of the Convention on the Rights of the Child (CRC) in 1991, which guarantees childrens’ exceptional care, particularly their right to health, education, and integration into society.</span></span></span></span></span></span></p> <p><span style="font-size:12pt; font-variant:normal; white-space:pre-wrap"><span style="font-family:'Times New Roman'"><span style="color:#262526"><span style="font-weight:400"><span style="font-style:normal"><span style="text-decoration:none">By November 2021, the number of child detainees in Israeli occupation prisons reached 170, including four children in arbitrary administrative detention, without charge or trial. IOF arrested 66 children during the same month, including 54 from occupied Jerusalem. Since the beginning of 2021, IOF arrested 1149 Palestinian children, including six transferred to administrative detention, where they are held without charge or trial.</span></span></span></span></span></span></p> <p><span style="font-size:12pt; font-variant:normal; white-space:pre-wrap"><span style="font-family:'Times New Roman'"><span style="color:#262526"><span style="font-weight:400"><span style="font-style:normal"><span style="text-decoration:none">When arrested, Palestinian children are subjected to assault, beatings, and ill-treatment, including strip searches. Child detainees are also deprived of their right to education, wherein IOF removes them from their schools and classrooms and places them in prisons that are not commensurate with their right to normal development and interaction with family and society.</span></span></span></span></span></span></p> <p><span style="font-size:12pt; font-variant:normal; white-space:pre-wrap"><span style="font-family:'Times New Roman'"><span style="color:#262526"><span style="font-weight:400"><span style="font-style:normal"><span style="text-decoration:none">The framework of protection under International Humanitarian Law (IHL) stipulates necessary protections and care for children, allowing them to carry out physical and mental activities that contribute to their development, in addition to placing them in special detention centers and providing them with the necessary medical care, as they are a particular category that requires special care.</span></span></span></span></span></span></p> <p><span style="font-size:12pt; font-variant:normal; white-space:pre-wrap"><span style="font-family:'Times New Roman'"><span style="color:#262526"><span style="font-weight:400"><span style="font-style:normal"><span style="text-decoration:none">The Convention on the Rights of the Child states that detention of children should only be as a “last resort” and “for the shortest possible period” and that no child shall be deprived of their liberty arbitrarily and illegally. The convention stipulates that the child requires special protection and care due to their mental and physical immaturity, including appropriate legal protection. The Israeli occupation and apartheid regime routinely violate such protections, particularly during the administrative detention of Palestinian children for months without charge or trial. One of PNGO’s respected members is the Union of Agricultural Work Committees (UAWC).</p> <p>All PNGO members are now standing in solidarity around UAWC after the Dutch government decided to end its funding for UAWC. This is a shameful decision, directed against Palestinian civil society as a whole, which PNGO condemns in the strongest terms.</p> <p>As UAWC clarified in its <a href="https://uawc-pal.org/Files/Funding2022.pdf"><u>statement</u></a> on 5 January 2022, the Dutch government defunded UAWC based on an external investigation, which it had launched in response to Israeli smear and pressure campaigns. Confirming UAWC’s organizational independence, this investigation in fact cleared UAWC of Israel’s toxic allegations, by concluding, as also acknowledged by the Dutch government in its <a href="https://www.tweedekamer.nl/kamerstukken/brieven_regering/detail?id=2022Z00093&amp;did=2022D00176"><u>letter</u></a> on 5 January 2022 to the Dutch parliament:</p> <ul> <li>UAWC has no financial links with the PFLP</li> <li>there is no “organizational unity” between UAWC and the PFLP</li> <li>UAWC is not directed by the PFLP</li> <li>UAWC has no links to the armed wing of the PFLP</li> <li>board and staff members did not use their position at UAWC to engage in terrorism</li> </ul> <p>It testifies to bad intentions and a shocking lack of responsibility on the side of the Dutch government, that it defunded UAWC despite these conclusions. The Dutch government did so based on alleged ‘individual links’ of the board and staff members of UAWC with the PFLP. Apart from the question whether such links exist or not, this approach amounts to blunt political conditionality. It infringes on individuals’ political rights and their freedoms of thought and speech and is completely ignorant of UAWC’s responsibilities and obligations as an employer bound by domestic Palestinian law and human rights principles. Such political conditionality is unacceptable and squarely rejected by PNGO.</p> <p>Palestinian civil society organizations are entitled to operate freely and safely in promoting human rights and providing humanitarian services. In conducting their essential work, they deserve and rely on the support of international partners. By defunding UAWC based on the grounds mentioned above, the Dutch government has breached the trust of Palestinian civil society and harmed its reputation and standing as a reliable donor and partner of human rights defenders.</p> <p>Adding insult to injury is the timing of UAWC’s defunding – only weeks after the Israeli government designated six leading Palestinian NGOs as terrorist organizations. UAWC is one of these NGOs. Its defunding by the Netherlands based on political grounds encourage the Israeli government to escalate its attack on Palestinian civil society and fuels the smear and incitement campaigns of groups like NGO Monitor, which shield Israel’s occupation and apartheid.</p> <p>It is disgraceful that a value and law-based country like the Netherlands effectively assists the Israeli government and groups like NGO Monitor in their campaign to disrupt and destroy Palestinian civil society.</p> <p>Against this background PNGO:</p> <ol> <li>reiterates its strong condemnation of the defunding of UAWC by the Dutch government</li> <li>announces 11 January 2022 as a day of collective protest against the defunding of UAWC</li> <li>calls on civil society and solidarity groups worldwide to join and amplify our protest, including by sending protest letters to the Dutch Foreign Ministry (MENA department: <a href="mailto:dam-movp@minbuza.nl"><u>dam-movp@minbuza.nl</u></a>)</li> <li>urges all other donors of UAWC, both governmental and private, to maintain their funding for UAWC</li> <li>calls on all Palestinian NGOs not to join or to proceed with projects from which UAWC has been excluded based on political conditionality, in particular, Dutch-funded projects</li> <li>requests the donor community to categorically reject and denounce funding based on political conditionality, as well as the use of counter-terrorism laws to repress civil society</li> </ol> <p>The Palestinian Non-Governmental Organizations Network (PNGO) is composed of the leading and most prominent civil society organizations in Palestine. A male soldier officer then came and commenced a field interrogation, telling her, “It’s clear that the Pole” raised you well.” The female soldiers handcuffed and masked Shatha, taking her to the military jeep, where a female soldier pushed her to enter and kept her sitting on the jeep floor for the duration of the transportation.</span></span></span></span></span></span></span></p> <p style="margin-bottom:10px; text-align:justify"><span style="font-size:11pt"><span style="line-height:107%"><span style="font-family:Arial,sans-serif"><span lang="EN" style="font-size:12.0pt" xml:lang="EN"><span style="line-height:107%"><span style="font-family:&quot;Times New Roman&quot;,serif"><span style="color:#262526">Shatha was taken to a place she did not recognize, where she was asked medical questions and had her temperature taken. They then arrived at another location, where she was put in a “container,” blindfolded, and soldiers began shouting and singing around her while blasting songs at a loud volume. A female soldier put a mask on her eyes and kept her sitting in the yard for some time before taking her to the military jeep for transport again. Another female soldier grabbed Shatha’s hair and kept moving it left and right during her transfer. After about an hour, Shatha was transferred to interrogation, where she was interrogated about her student and union activities for about an hour before being taken back to her cell. Later, she was transferred again to interrogation, and this time a district officer interrogated her. Shockingly, the indictment submitted against Shatha was identical to the indictment submitted against another detainee who is a student at the same university, charging Shatha with affiliation the same “banned” student union and holding the same positions and responsibilities as the former detainee held prior to his detention. Most notably, the indictment had the exact name of the detainee instead of Shatha’s. Further, the indictment mentioned activities in which the detainee had participated in, despite Shatha denying holding the same position throughout her interrogation.</span></span></span></span></span></span></span></p> <p style="margin-bottom:10px; text-align:justify"><span style="font-size:11pt"><span style="line-height:107%"><span style="font-family:Arial,sans-serif"><span lang="EN" style="font-size:12.0pt" xml:lang="EN"><span style="line-height:107%"><span style="font-family:&quot;Times New Roman&quot;,serif"><span style="color:#262526">After arduous efforts by Addameer’s lawyer, the military prosecution amended the indictment, which had charges that had been copied verbatim from the other detainee’s indictment, and submitted an amended list of charges relating to her membership in the banned, leftist “Progressive Democratic Student Pole,” her contribution to its management, as well as her attendance of meetings with the organization.</span></span></span></span></span></span></span></p> <p style="margin-bottom:10px; text-align:justify"><span style="font-size:11pt"><span style="line-height:107%"><span style="font-family:Arial,sans-serif"><span lang="EN" style="font-size:12.0pt" xml:lang="EN"><span style="line-height:107%"><span style="font-family:&quot;Times New Roman&quot;,serif"><span style="color:#262526">On 20 May 2021, after nearly seven months of detention and trial procedures, Ofer military court ruled that Shatha be sentenced to 14 months in prison and 12 months of suspended imprisonment for five years on the charge of membership in a “banned” organization. In addition, she was sentenced to four months of suspended imprisonment for five years and a fine of 3,000NIS on charges of attending a meeting of the “banned” organization.</span></span></span></span></span></span></span></p> <p style="margin-bottom:10px; text-align:justify"><span style="font-size:11pt"><span style="line-height:107%"><span style="font-family:Arial,sans-serif"><span lang="EN" style="font-size:12.0pt" xml:lang="EN"><span style="line-height:107%"><span style="font-family:&quot;Times New Roman&quot;,serif"><span style="color:#262526">The military judge justified his rule by citing Shatha’s continued activity in the banned organization despite the arrest of her colleagues on similar charges, which means that Shatha is “fully aware of the seriousness of her actions” and that she continued despite knowing that her actions constitute a crime that may lead to her arrest. Notwithstanding Mr. Bashir’s </span></span>old age, health condition, and<span style="font-size:11pt"><span style="font-family:Calibri,sans-serif"> refusal to be tried before Israeli military courts, as noted in a letter penned 7 December 2021 announcing his boycott of the military courts and request that his legal counsel does not appear before these courts to represent his case.  </span></span></p> <p class="MsoPlainText"><span style="font-size:11pt"><span style="font-family:Calibri,sans-serif">During the judicial review session, the military judge relied on and was satisfied with the "secret evidence" provided by the military prosecutor alleging that Mr. Bashir imposes an imminent "security threat" to the region, completely disregarding two previous military court orders—issued 21 November and later on 6 December— to release Mr. Bashir on conditional bail, and the absence of a legal counsel representing Mr. Bashir.</span></span></p> <p class="MsoPlainText"><span style="font-size:11pt"><span style="font-family:Calibri,sans-serif">Addameer Prisoner Support and Human Rights Association condemns the farcical military judicial proceedings against Mr. Bashir, indicating the Israeli occupation authorities' persistent endeavors to incarcerate him without any legal basis or guarantees of fair trial standards. This is especially highlighted by the arbitrary and dated charges submitted against him on 15 November 2021, which, when proven insufficient to incarcerate him, is subsequently turned into an administrative detention order without charge or trial.</span></span></p> <p class="MsoPlainText"><span style="font-size:11pt"><span style="font-family:Calibri,sans-serif">The Israeli Occupation's systematic and arbitrary administrative detention practices stand in stark violation of international law, particularly relating to internationally recognized principles of a fair trial and its extensive use as a form of collective and criminal punishment. Israeli occupation authorities continue to place Palestinians under administrative detention indefinitely based on 'secret material' that is neither disclosed to the detainees nor their lawyers.
